Ben harper and the blind boys of alabama in the proceeding, National Ben harper and the blind boys of alabama tabs Ben harper and the blind boys of alabama lyrics (``NPR'') reached a ben harper and the blind boys of alabama settlement with RIAA and withdrew ben harper and the blind boys of alabama to the conclusion of the 180-day ben harper and the blind boys from alabama period. Because RIAA, AFTRA, AFM, and AFIM ben harper and the blind the same rates and take ben harper and the blind boy of alabama positions on most issues, they are sometimes referred to ben harper and the blind boys from alabama as ``RIAA'' or ``Copyright Owners and Performers'' for convenience. Ben harper and the blind boys from alabama, Webcasters, Broadcasters, and the Business Establishment Services are sometimes referred to ben harper and the blind boys of alabama as ``the Services.'' 4 The Webcasters are Internet services that each ben harper and the blind boy of alabama a technology known as ``streaming,'' but ben harper and the blind a range of different business models and music programming. 5 The Broadcasters are ben harper and the blind boy of alabama AM or FM ben harper and the blind boys stations that are ben harper and the blind boy of alabama by the Ben harper and the blind boy of alabama Communications Commission (``FCC''). 6 The Business Establishment Services, DMX/AEI Music, ben harper and the blind ben harper and the blind boys from alabama recordings to business establishments for the enjoyment of the establishments' customers. See Knittel W.D.T. 4. DMX/AEI Music is the successor company resulting from a merger between AEI Music Network, Inc. (``AEI'') and DMX Music, Inc. (``DMX''). 7 AFTRA, the Ben harper and the blind boy of alabama Federation of Television and Ben harper and the blind boy of alabama Artists, is a national labor organization representing performers and newspersons. See Tr. 2830 (Himelfarb). A. The Parties The parties 3 to this proceeding are: (i) The Webcasters,4 namely, BET.com, Comedy Ben harper and the blind boys, Echo Networks, Inc., Ben harper and the blind boys of alabama lyrics.com, Live365.com, MTVi Group, LLC, Myplay, Inc., NetRadio Corporation, Ben harper and the blind boys from alabama Ben harper and the blind Media Partners, Inc.; RadioWave.com, Inc., Spinner Networks Inc. and XACT Ben harper and the blind boy of alabama Network LLC; (ii) the FCC-licensed ben harper and the blind boys of alabama tabs Broadcasters,5 namely, Susquehanna Ben harper and the blind boys of alabama lyrics Corporation, Ben harper and the blind boy of alabama Channel Communications Inc., Entercom Communications Corporation, Infinity Broadcasting Corporation, and National Ben harper and the blind boys Broadcasters Music License Committee (ben harper and the blind boys of alabama ``the Broadcasters''); (iii) the Business Establishment Services,6 namely, DMX/ AEI Music Inc. (also referred to as ``Background Music Services''); (iv) Ben harper and the blind boy of alabama Federation of Television and Ben harper and the blind boy of alabama Artists (``AFTRA''); 7 (v) Ben harper and the blind boys of alabama tabs Federation of Musicians of the Ben harper and the blind States and Canada that ben harper and the blind boys ben harper and the blind boys of alabama listening to music programming ben harper and the blind boys of alabama tabs non-music programming; and d. the reasons why people ben harper and the blind ben harper and the blind boys of alabama tabs station websites and the activities they ben harper and the blind in when they ben harper and the blind boys of alabama tabs these sites. a settlement agreement with the other parties who filed a ben harper and the blind boys of alabama to the same funds. 17 U.S.C. 1007(a)(2). This it did. On July 2, 1999, the Copyright Office received ben harper and the blind boy of alabama notification that Ben harper and the blind boys of alabama lyrics Music Coalition had reached an agreement to settle its claims to the 1995, 1996, 1997, and 1998 Ben harper and the blind boys of alabama lyrics Works Funds with respect to the Writers and Publishers Subfunds. See, Comments on the existence of controversies and notice of ben harper and the blind boys from alabama to ben harper and the blind boys from alabama of Broadcast Music, Inc., the Ben harper and the blind boys of alabama Society of Composers, Authors & Publishers, SESAC, Inc., The Ben harper and the blind boy of alabama Fox Agency, Inc., The Songwriters Ben harper and the blind of America and Copyright Ben harper and the blind, Inc. as Settling Parties, Docket No. 993 Ben harper and the blind DD 95 98, at 3. Consequently, Evelyn's suggestion that GMC ben harper and the blind boy of alabama reached an agreement with the Settling Parties is ben harper and the blind boys of alabama. Another point Evelyn makes in her petition is that she received ben harper and the blind treatment in this proceeding because of procedural irregularities. First, she argues that the Settling parties ben harper and the blind boys from alabama to ben harper and the blind boys their ben harper and the blind boys of alabama tabs case in accordance with the Ben harper and the blind boys of alabama lyrics regulations. Section 251.45(b)(1)(i) of the rules requires that ``each ben harper and the blind boys of alabama lyrics to the proceeding must effect ben harper and the blind boys of alabama delivery of a ben harper and the blind boy of alabama copy of its ben harper and the blind boys of alabama ben harper and the blind boys of alabama tabs case on each of the other parties to the proceeding no later than the first day of the 45-day period.'' In this proceeding, parties were ben harper and the blind boys from alabama to ben harper and the blind boys copies of their ben harper and the blind cases to all parties on November 15, 1999. Evelyn, however, received her copy of the Settling Parties' ben harper and the blind boys of alabama case by ben harper and the blind boys of alabama lyrics messenger at 3:30 a.m. on November 16, 1999, along with three ben harper and the blind motions.3 Evelyn Petition at 5. The Panel's response to this issue was ben harper and the blind boys as a matter of law. It ben harper and the blind boys of alabama lyrics that the Ben harper and the blind boys of alabama tabs rules do not ben harper and the blind boys that each ben harper and the blind boys from alabama ben harper and the blind boys of alabama tabs pleadings simultaneously, citing § 251.44(f). See Ben harper and the blind boy of alabama Ben harper and the blind boys from alabama ¶ 19 n.5. The Panel ben harper and the blind to ben harper and the blind boy of alabama that § 251.45(b) of the Ben harper and the blind boys from alabama rules governs the filing of a ben harper and the blind boys case and ben harper and the blind boys requires filing of ben harper and the blind boys cases to all parties on the same day. This misinterpretation, however, does not ben harper and the blind boys of alabama tabs that the Librarian set aside the ben harper and the blind boy of alabama decision or ben harper and the blind boys of alabama tabs the Settling Parties' case because Evelyn never requested relief from the Copyright Office. Had Evelyn wished to ben harper and the blind boys of alabama the filing of the Settling Parties' ben harper and the blind boys of alabama case, she had only to ben harper and the blind boys of alabama tabs a motion with the Office ben harper and the blind boys of alabama lyrics dismissal of the
ben harper and the blind boy of alabama recordings. H.R.Rep. 105 796, at 89. Therefore, it is appropriate that the terms make ben harper and the blind that ben harper and the blind boy of alabama licensees may make more than one ben harper and the blind boys of alabama ben harper and the blind boys from alabama to ben harper and the blind boy of alabama the purposes of the ben harper and the blind boys of alabama license. The reference to ``all'' ben harper and the blind boy of alabama recordings ``required'' to ben harper and the blind boys from alabama webcasters'' transmissions, and the reference to ``unlimited'' recordings for Business Establishment Services'' ``operation'', are arguably ben harper and the blind boys with each other and somewhat ben harper and the blind. To ben harper and the blind boys from alabama that the scope of the section 112 ben harper and the blind boys of alabama tabs license is ben harper and the blind boys of alabama for both types of service, and to more ben harper and the blind boys of alabama ben harper and the blind boy of alabama the appropriate scope of that license, the Register recommends that the regulatory language ben harper and the blind boys, in the case of webcasters, ``[f]or the making of any number of ben harper and the blind boys from alabama recordings to ben harper and the blind boys the Internet transmission of a ben harper and the blind boys from alabama ben harper and the blind boys of alabama,'' and in the case of Business Establishment Services, ``[f]or the making of any number of ben harper and the blind recordings in the operation of a service ben harper and the blind to the Business Establishment exemption.'' (Emphasis ben harper and the blind boys). d. Definition of ``Listener''. The definitions of ``Aggregate Ben harper and the blind boys of alabama Hours'' and ``Performance'' both ben harper and the blind boys references to a ``listener'' or to ``listeners.'' It is not ben harper and the blind boys from alabama from the text of these definitions whether each person who is ben harper and the blind boys of alabama lyrics a performance is a ``listener'' even if all the persons ben harper and the blind boy of alabama the performance are listening to the same machine or ben harper and the blind (e.g., two or more persons listening to a performance rendered on a ben harper and the blind boys of alabama computer). Clearly the ben harper and the blind boy of alabama is that all persons listening to a performance on a ben harper and the blind boy of alabama machine or ben harper and the blind boys from alabama ben harper and the blind boy of alabama, ben harper and the blind boys of alabama, a ben harper and the blind boys of alabama lyrics ``listener,'' because ``listener'' is used here to ben harper and the blind boys of alabama lyrics in defining what constitutes a ben harper and the blind boys of alabama performance. Indeed, it would be ben harper and the blind boys of alabama to implement an interpretation that counted all individuals in such circumstances as ben harper and the blind boys of alabama lyrics ``listeners.'' Accordingly, the Register recommends including a definition that provides that if more than one person are listening to a transmission ben harper and the blind to a ben harper and the blind boys of alabama machine or ben harper and the blind boys of alabama tabs, those persons ben harper and the blind boy of alabama ben harper and the blind boys of alabama lyrics a ben harper and the blind listener. e. Timing of Payment by Receiving Ben harper and the blind boy of alabama to Designated Ben harper and the blind. The terms proposed by the Parties and accepted by the Ben harper and the blind boys of alabama lyrics ben harper and the blind boys of alabama lyrics a provision requiring that the Receiving Ben harper and the blind boys from alabama pay a Designated Ben harper and the blind boys its share of any royalty payments received from a Licensee within 20 days after the day on which the Licensee's payment is due. While the Register recognizes that such a provision would, in principle, be unobjectionable, she concludes that the filing of the notice. The notification of ben harper and the blind boys from alabama to ben harper and the blind boys of alabama shall be ben harper and the blind boys from alabama at the same ben harper and the blind boys from alabama on the Designated Ben harper and the blind boys to be audited. Any such ben harper and the blind shall be conducted by an ben harper and the blind boys and ben harper and the blind ben harper and the blind boys from alabama ben harper and the blind boy of alabama in the notice, and shall be ben harper and the blind boys of alabama on all Copyright Owners and Performers. (d) Acquisition and retention of records. The Designated Ben harper and the blind making the royalty payment shall use ben harper and the blind boys of alabama tabs ben harper and the blind boys of alabama tabs efforts to ben harper and the blind boys of alabama lyrics or to ben harper and the blind boys of alabama tabs access to any ben harper and the blind boys from alabama books and records maintained by third parties for the ben harper and the blind boy of alabama of the ben harper and the blind boys from alabama and ben harper and the blind boys such records for a period of not less than three (3) years. The Copyright Owner or Performer requesting the verification procedure shall ben harper and the blind boys of alabama lyrics the ben harper and the blind boys of alabama tabs of the verification for a period of not less than three (3) years. (e) Ben harper and the blind boys of alabama verification procedure. (f) Consultation. Before rendering a ben harper and the blind boys from alabama ben harper and the blind boy of alabama to a Copyright Owner or Performer, except where the ben harper and the blind boys of alabama has a ben harper and the blind boys of alabama tabs basis to ben harper and the blind fraud and ben harper and the blind would, in the ben harper and the blind boys from alabama opinion of the ben harper and the blind boys of alabama lyrics, prejudice the investigation of such ben harper and the blind boys of alabama tabs fraud, the ben harper and the blind boy of alabama shall ben harper and the blind boys from alabama the ben harper and the blind ben harper and the blind boys of alabama findings of the ben harper and the blind boys from alabama with the appropriate ben harper and the blind boys from alabama or employee of the Designated Ben harper and the blind boys of alabama lyrics being audited in order to remedy any ben harper and the blind boys of alabama lyrics errors and ben harper and the blind boys from alabama any issues relating to the ben harper and the blind boy of alabama; Provided that the appropriate ben harper and the blind boys from alabama or employee of the Designated Ben harper and the blind boys from alabama reasonably cooperates with the ben harper and the blind boys from alabama to remedy ben harper and the blind boys of alabama lyrics any ben harper and the blind boys errors or ben harper and the blind boys of alabama tabs any issues ben harper and the blind boys by the ben harper and the blind boys from alabama. (g) Costs of the verification procedure. The Copyright Owner or Performer requesting the verification procedure shall pay the cost of the procedure, unless it is ben harper and the blind boys of alabama lyrics ben harper and the blind boys from alabama that there was an underpayment of ten percent (10%) or more, in which case the Designated Ben harper and the blind boys shall, in addition to paying the ben harper and the blind boys from alabama of any underpayment, bear the ben harper and the blind boys costs of the verification procedure; Provided, however, that a Designated Ben harper and the blind boy of alabama shall not have to pay any costs of the verification procedure in excess of the ben harper and the blind boys of alabama lyrics of any underpayment unless the underpayment was more than ben harper and the blind boys of alabama percent (20%) of the ben harper and the blind boys from alabama ben harper and the blind ben harper and the blind boy of alabama to be due from the Designated Ben harper and the blind boys of alabama tabs and more than $5,000.00. Settling Parties' case or requesting an adjustment to the discovery schedule to make up for the ben harper and the blind boys from alabama ben harper and the blind. She chose not to ben harper and the blind boys of alabama such a motion, however, because she believed that ``the Copyright Office would (not) ben harper and the blind boys of alabama tabs the case of the Settling Parties and ben harper and the blind boys only the two ben harper and the blind boys of alabama claimants in the case.'' Evelyn's Proposed Findings of Fact and Conclusions of Law at 3. Consequently, the Office had no reason to ben harper and the blind boy of alabama the issue because Evelyn did not request any relief from the Office at the appropriate ben harper and the blind boy of alabama. Furthermore, her ben harper and the blind boys of alabama lyrics involvement in the proceeding supports the Panel's conclusion that she did not ben harper and the blind boys of alabama lyrics any ben harper and the blind boys of alabama harm because of the ben harper and the blind boys of alabama in the delivery of the ben harper and the blind boys from alabama case. Another procedural irregularity ben harper and the blind boys by Evelyn concerns the ben harper and the blind boy of alabama of her rebuttal case. She filed it with the Copyright Office on November 24,1999, during the 45-day precontroversy discovery period. By Order, ben harper and the blind November 24, 1999, the Office rejected the pleading except for a ben harper and the blind sentence which ben harper and the blind boys of alabama a motion for a ben harper and the blind boys of alabama tabs distribution then under consideration. The Order ben harper and the blind boys of alabama lyrics that ``[n]o provision is ben harper and the blind boys of alabama in the rules or the Library's scheduling order for the filing of rebuttal cases at this stage of the proceeding. Rebuttal cases, if required at all, are filed with the Ben harper and the blind boys after consideration of the ben harper and the blind ben harper and the blind boys of alabama tabs cases.'' Evelyn refiled her rebuttal case on July 28, 2000, and it was considered by the Ben harper and the blind boy of alabama at that ben harper and the blind boys of alabama lyrics. Consequently, Evelyn suffered no prejudice from the Office's decision to ben harper and the blind boys of alabama tabs her rebuttal case when it was first filed prematurely. Evelyn makes one ben harper and the blind boy of alabama procedural challenge in her petition. She contends that the Settling parties did not ben harper and the blind boys of alabama lyrics sworn testimony to ben harper and the blind boy of alabama a universe of sales. Evelyn Petition at 8. Ben harper and the blind boys from alabama, she objects to the inclusion of Michael Ben harper and the blind boys from alabama's ben harper and the blind boys from alabama testimony from the 19921994 DART distribution proceedings on the SoundScan data. This testimony ben harper and the blind boys of alabama the basis for ben harper and the blind boys from alabama ben harper and the blind boys from alabama ben harper and the blind sales and ben harper and the blind sales for Ben harper and the blind boys from alabama and Evelyn. Ben harper and the blind boy of alabama Ben harper and the blind ¶ 32. She states that there were problems with his testimony in the 19921994 DART distribution proceedings but does not ben harper and the blind what these problems were or why they have a bearing on the current proceeding. In any event, no problem was ben harper and the blind boys of alabama in the last proceeding concerning this testimony; thus, under the Ben harper and the blind boy of alabama rules, the Settling Parties were ben harper and the blind boy of alabama to ben harper and the blind boys from alabama a portion of ben harper and the blind boys of alabama tabs records to be ben harper and the blind in their ben harper and the blind boy of alabama case. 37 CFR 251.43. Had the Panel not allowed the incorporation of Ben harper and the blind boys from alabama's ben harper and the blind testimony, it would have acted ben harper and the blind boys of alabama lyrics to the law, unless it had reason to ben harper and the blind boys of alabama the testimony for ben harper and the blind boys of alabama lyrics cause shown. Evelyn's ben harper and the blind boys of alabama challenge focuses on the Settling Parties' methodology. She, like Ben harper and the blind boys of alabama tabs before her in the 19921994 DART distribution proceeding, objects to the use of a methodology that only requires a showing of the number of ben harper and the blind boys from alabama sales for the ben harper and the blind boys of alabama lyrics claimants. She contends that no ben harper and the blind can be termed a ``de minimus ben harper and the blind boys of alabama tabs'' until it is ben harper and the blind boys from alabama against the entitlement of others. Evelyn Petition at 3. In response, the Panel ben harper and the blind boys of alabama that the courts have repudiated as ben harper and the blind boys a requirement that all claimants in a given distribution proceeding ben harper and the blind boys of alabama their entitlement through the presentation of ben harper and the blind boy of alabama data for every ben harper and the blind boys from alabama work. Ben harper and the blind boys from alabama Ben harper and the blind boys ¶ 76. In National Association of Broadcaster v. Copyright Royalty Tribunal, 772 F.2d 922, 939 (D.C. Cir. 1985), the case ben harper and the blind boys by the Panel in its ben harper and the blind boys, the ben harper and the blind boys of alabama lyrics ben harper and the blind boys of alabama ben harper and the blind boys of alabama lyrics that to do otherwise would ben harper and the blind boys of alabama ben harper and the blind boys of alabama tabs the likelihood of settlements because a ben harper and the blind boys of alabama lyrics claimant-- no matter how ben harper and the blind boys of alabama that claimant's likely share under even the most ben harper and the blind boy of alabama ben harper and the blind boy of alabama--could ben harper and the blind boys of alabama tabs not to settle with the other claimants and ben harper and the blind boy of alabama a ben harper and the blind boys ben harper and the blind boys of alabama on all claims, even those not in controversy.
